INTERNAL RULES OF PROCEDURE OF THE "ŽALGIRIS" SWIMMING POOL

  1. CONCEPTS

    1. Responsible Person – a capable and legally competent natural person or legal entity, including the Accompanying Person and the Personal Assistant, who, by signing the Rules, assumes full responsibility before the Manager for the conduct of Users visiting on the basis of a Shared Membership, Family Ticket, written consent of parents/guardians or a service package for companies, proper familiarization of Users with these Rules, compliance with the Rules, damage caused to the Pool, as well as the fulfillment of all financial obligations arising from the use of the Pool (e.g., overtime fees or payments in the bar area).

    2. Personal assistant – a natural person who provides personal assistance to a person with a disability whose disability certificate indicates that he or she is entitled to receive assistance from a personal assistant.

    3. Swimming pool – Žalgiris swimming pool, located at Karaliaus Mindaugo Ave. 50, Kaunas.

    4. Pool staff – all persons working or providing services at the Pool (reception staff, administrators, technical staff, etc.).

    5. A ticket is a document that entitles the Visitor to a visit to the Pool for a set period of time (90 minutes or 3 hours), which is activated and valid depending on the method of purchase: a single-use ticket purchased at the box office is activated at the time of purchase and gives the right to enter the Pool within 15 minutes of its issuance, while a single-use ticket purchased online must be activated no later than 14 calendar days from the date of purchase.

    6. Shared Membership – A type of recurring membership that entitles the Visitor to use the Pool areas together with other Visitors during the Pool's operating hours, in accordance with the terms and conditions of shared membership and these Rules.

    7. Gift voucher – a document confirming the prepayment of a fixed amount (30 EUR, 60 EUR, 100 EUR) for Pool services, which is valid for 180 days from the date of its purchase.

    8. Lifeguards are specially trained Pool employees wearing red T-shirts with the words "Lifeguard" written on them, who ensure the safety of Pool visitors and provide first aid.

    9. Gross violation – any act or behavior committed intentionally or due to gross negligence by a Visitor that endangers the life, safety and/or health of the Visitor or other persons, causes or may cause property damage to the Pool's property, infrastructure, or property of other persons, as well as substantially violates public order or these Rules, including, but not limited to, fights, harassment, disturbance of public order, aggressive or offensive behavior, smoking in the Pool's premises or other violations.

    10. Challenge Course – an inflatable obstacle course in the water, designed for active leisure of Visitors and safe sports or entertainment use in the Pool premises.

    11. Credit – a monetary limit set by the Manager for the Visitor's Smart Bracelet, intended to pay for additional goods and services (e.g., at the bar or hydromassage) in the Pool.

    12. Visitor – any person, including persons visiting under the rights of a User, except for Pool personnel, who has entered the Pool by any lawful means established by the Manager: Ticket, On the basis of a shared membership, recurring membership, term membership, gift voucher, invitation or permission of the Manager, as well as by using other means determined by the Manager.

    13. Accompanying person – an adult (parent, guardian, coach or other person) who accompanies minors or persons with disabilities and assumes full responsibility for their safety, behavior and compliance with the Rules.

    14. A smart bracelet is an individual device provided to the Visitor to enter the Pool, open and close the locker, and pay for additional services.

    15. Generational Membership – a type of membership that entitles the Visitor to use the Pool a set number of visits within a set period of time (e.g., 6 times in 1 month or 12 times in 3 months). A recurring membership must be activated within 14 (fourteen) calendar days from the date of purchase, otherwise it will be activated automatically on the 14th day and its validity period will begin to count.

    16. Membership Transfer Form – a document in the form established by the Manager, on the basis of which a One-Time Membership or Term Membership may be transferred to another person for a fee established by the Manager (10 EUR).

    17. User – A Visitor who exercises the right granted to him by the Responsible Person to visit the Pool.

    18. Invitation – a document (paper or electronic) intended for a single visit to the Pool or for the use of a Lifetime Membership, valid for 90 calendar days from the date of purchase.

    19. Family Ticket – A ticket intended for family members, i.e. one or two minors aged 5 to 17 and two adults – parents or guardians, one of whom is the Responsible Person.

    20. Rules – these internal rules of the Žalgiris pool.

    21. Term membership – a type of membership (e.g. monthly membership "Unlimited" or "Active Morning"), granted only to persons over 18 years of age who have concluded a term membership contract and pay a fixed monthly fee. Membership is activated immediately after the first payment is made and is valid until the end of the term specified in the contract.

    22. Parental consent form – a document by which parents/guardians confirm that: i) the minor's health condition is suitable for using the Pool; ii) the minor has fully familiarized himself with the Rules and has undertaken to comply with them; iii) the person signing the consent is responsible for compliance with the Rules and undertakes to compensate for any damage caused to the Pool by the minor in accordance with the procedure established by the legal acts of the Republic of Lithuania.

    23. The Manager is a budgetary institution Kaunas Swimming School (legal entity code 195470111, registered office address Demokratų g. 34, LT48421 Kaunas, tel. no. +37069448388, e-mail: zalgiriobaseinas@swim.lt), responsible for the management of the Pool and the provision of services.

  2. GENERAL PROVISIONS

    1. Visitors can use: 50-meter swimming pool, 25-meter swimming pool, recreational pools, whirlpools, saunas, group training.

    2. These Rules are publicly announced and are binding on all Visitors, as well as Responsible Persons and Accompanying Persons, regardless of their age. Before purchasing a Pool service (Ticket, Annual Membership, Term Membership, Invitation, etc.), a person must familiarize himself with these Rules and, when using the Pool services, comply with them. The Responsible Person must ensure that Users are properly informed of these Rules and comply with them.

    3. The Visitor (or Responsible Person) is fully responsible for the Visitor's health status and ability to use the services provided by the Pool. The Manager and the Pool staff are not liable for any health problems, injuries or accidents of the Visitor that occur while visiting the Pool.

    4. Visitors of any age have the right to use the services provided by the Pool, except for the exceptions provided for in these Rules.

    5. The following persons are prohibited from visiting the pool:

      1. those with COVID-19 or any other viral/infectious disease;

      2. suspected of having COVID-19 or any other viral/infectious disease;

      3. who have had contact with someone with COVID-19 or any other viral/infectious disease;

      4. those with conjunctivitis, infectious skin diseases;

      5. those with open wounds;

      6. those intoxicated by alcohol, narcotics or psychotropic substances;

      7. those with other ailments that pose or may pose a threat to their own health and safety or that of other Visitors;

      8. whose behavior poses a danger to the Pool, its safety and hygienic condition or contradicts the rules of good behavior accepted in society.

    6. Visitors who experience any health problems in the Pool must contact a Lifeguard or other Pool staff.

    7. The pool reserves the right to deny entry to any person(s) who refuse to agree to the Rules.

    8. In case of violation of these Rules, the Visitor must immediately leave the Pool if requested by the Manager.

    9. The Operator reserves the right to temporarily restrict, completely suspend the provision of services or prohibit the use of certain areas of the Pool (e.g., specific pools, saunas, whirlpools or group classes) due to technical prevention, sports events (competitions), force majeure circumstances , failures or accidents in city engineering networks and other reasons beyond the control of the Operator. Visitors are informed in advance about the planned restrictions (on the website, at the reception and/or on social networks). In such cases, the Pool service fees are not recalculated, money is not refunded and the validity period is not extended.

    10. If there are any questions or uncertainties, Visitors must contact the Pool staff.

  3. POOL SERVICES PURCHASE PROCEDURE, FEES AND VALIDITY

    1. Pool service fees are published at the Pool box office and on the website www.zalgiriobaseinas.lt . Tickets and memberships are sold at the Pool box office and on the website.

    2. Persons wishing to purchase the services of the Pool must provide an identification document (passport, identity card, school/student ID card, etc.). If necessary, the Pool staff has the right to request the presentation of an identification document at any time (for example, if there are doubts about the Visitor's age).

    3. The Manager reserves the right to temporarily not sell Tickets due to technical difficulties or if all storage lockers are full.

    4. After purchasing a Ticket or a Membership and deciding not to use the services, the money is not refunded and the service is not exchanged for another type of service.

    5. When purchasing a membership, a one-time membership card fee of 3.00 EUR is applied for the issuance of the Card. The Card is a necessary means of identification for the Visitor to enter the Swimming Pool, which the Visitor must present during each visit. If the Card is lost or damaged, a new Card is issued for a fee of 3.00 EUR. The Card may only be used by the person in whose name it was issued; its transfer to third parties is prohibited.

    6. The terms for activating the Pool Services depend on the selected type of Pool Services and the method of acquisition:

      1. A single-use Ticket purchased at the box office is activated at the moment of purchase, therefore the Visitor must pass through the entrance gate (Pool turnstile) no later than 15 minutes after purchasing the Ticket. If the Ticket is late, the Ticket becomes invalid, the Smart Bracelet or Card is automatically blocked, and the money for the Ticket is not refunded to the Visitor;

      2. The Visitor must activate the Ticket purchased online and the One-Time Membership purchased at the Pool Box Office or online within 14 calendar days from the date of purchase. If the One-Time Membership purchased online or at the Pool Box Office or online is not activated within the specified 14 calendar day period, it is activated automatically on the 14th calendar day and the validity period of the service specified in this clause begins to count from that day;

      3. Term membership is activated and becomes valid from the day of payment of the first installment, and subsequent installments are calculated from the 1st of the current month;

      4. The invitation is valid for 90 calendar days from the date of its purchase;

      5. The gift voucher is valid for 180 calendar days from the date of purchase.

    7. 3.6 (with subclauses) of the Rules REF _Ref224724750 \r \h \* MERGEFORMAT shall not be extended, transferred or otherwise compensated for, with the following exceptions:

      1. The validity period of a Generational Membership and Term Membership may be extended in the event of illness (including children's illnesses, if one of the parents or guardians was unable to visit the Pool due to this) by submitting a doctor's certificate or a certificate of incapacity for work to the Pool reception for the period specified therein (and if not specified - for no longer than 7 calendar days);

      2. The validity period of an unused Gift Voucher can be extended by 1 month for an additional fee of EUR 10;

      3. In other unforeseen cases, the Pool Administration reserves the right to make a decision on the suspension or extension of membership on an individual basis.

    8. The Ticket entitles the Visitor to one-time entry to the Pool area. If the Visitor leaves the exit gate early, i.e. if the entire allotted time limit is not spent, the Ticket expires automatically and the money for the remaining time is not refunded to the Visitor. In such a case, re-entry is possible only by purchasing a new Ticket.

    9. The number of tickets and the number of Smart Bracelets issued must correspond to the actual number of people entering through the entrance gates. Bracelets are not issued to children under 4 years of age, unless the Visitor requests otherwise.

    10. Children under 4 (four) years of age are charged EUR 1.00 . Children from 5 to 18 years of age are charged the fees set out in the Pool price list. For each minor exceeding the number of persons specified in the Family Ticket, an additional fee set out in the Pool price list is charged.

    11. Visitors must leave the Pool 15 (fifteen) minutes before the end of the Pool's work or immediately after the instruction of the Pool staff and exit through the control gates no later than the official end of working hours (22:00). Leaving after 22:00 an additional fee of 19 EUR is applied. A Visitor who leaves before 22:00, but exceeds his time limit, is given a 15 (fifteen) minute tolerance, after which the Visitor is subject to a fee of 3.00 EUR (for delays up to 30 minutes) or a fee of 19.00 EUR (for delays over 30 minutes). The Visitor must pay the amount for exceeding the time limit at the Pool's reception before leaving the Pool.

  4. MEMBERSHIP TERMS AND CONDITIONS AND TRANSFER PROCEDURE

    1. The terms and conditions of use of term memberships are described in the contracts.

    2. Both the One-Time Membership (except for the Shared Membership) and the Term Membership may only be used by the Visitor to whom the membership has been assigned. It is strictly prohibited to transfer the memberships specified in this clause to other persons without completing the membership transfer procedure in the manner specified below:

      1. The transfer of membership to another person is carried out at the Pool reception. by filling out the Membership Transfer Form;

      2. When transferring a membership, both parties must be present – the current membership holder and the person to whom the membership is being transferred;

      3. The new membership holder must sign and agree to these Rules, if they have not already done so.

    3. If you refuse to read or sign the Rules, your membership is not transferable and the new owner does not acquire the right to use the services.

    4. A membership transfer fee of 10 EUR applies for the transfer of membership.

    5. Membership can be transferred no more than 2 (two) times during the membership period.

    6. Term memberships are transferable only to persons over 18 years of age.

    7. Generational memberships that provide benefits for minors, schoolchildren, students, pensioners or persons with disabilities may only be transferred to another person who is entitled to the same type of benefit. At the time of transfer, the new membership holder must present a valid document (schoolchild, student, senior or disabled person's certificate) confirming the right to use the relevant benefit.

    8. The Responsible Person for Visitors using the Shared Membership is not entitled to transfer or transfer the Card or Smart Bracelet to third parties who are not officially registered as Shared Membership Users, and to arbitrarily change registered Users without prior notification of the Pool Administration. In case of suspicion that unregistered persons are using the Shared Membership service, the Pool Staff has the right to deny them entry to the Pool and unilaterally suspend the membership. The Responsible Person must inform the Pool Staff by e-mail, telephone or upon arrival at the location about any changes in the Shared Membership Users, as well as any damaged or lost Card (or Smart Bracelet) and/or about the extension of the Shared Membership.

  5. CHIP BRACELET, ITS PURPOSE AND USE

    1. When selling a Ticket, Annual Membership or Term Membership, each Visitor is individually issued a Chip Bracelet of the appropriate color.

    2. Upon receiving a Smart Bracelet, the Visitor is granted Credit, which can be used to purchase additional services at the Pool. Having used up part or all of the granted Credit limit, the Visitor must pay the resulting amount at the cash desk before leaving the Pool.

    3. Visitors must enter through the entrance gates one at a time, holding the Smart Bracelet to the reader. The time spent in the Pool begins to count from the moment of entering through the entrance gates and stops when the Visitor leaves through the exit gates, having placed the Smart Bracelet in the collector.

    4. With a smart bracelet in the pool area, a Visitor can:

      1. unlock and lock the storage locker;

      2. purchase goods at the bar;

      3. The information about the smart bracelet can be viewed on the infoterminal.

    5. A visitor who has lost their Smart Bracelet or damaged its electronic part must immediately contact the Pool staff to have the bracelet blocked and pay the established fee of EUR 10.00.

  6. OTHER GENERAL INFORMATION

    1. The pool's opening hours are posted on the entrance door to the pool and on the website www.zalgiriobaseinas.lt .

    2. The pool's opening hours during the summer are determined by the Pool administration and announced on the www.zalgiriobaseinas.lt website, Facebook account and at the Pool reception.

    3. The swimming pool may operate for a shorter period during public holidays of the Republic of Lithuania, information about this is provided on the website www.zalgiriobaseinas.lt , at the Swimming Pool reception and/or on social networks. During public holidays of the Republic of Lithuania, weekend visit fees apply, and group classes are not held.

    4. Lifeguards ensure the safety of visitors.

    5. The opening hours of the saunas are published on the swimming pool website www.zalgiriobaseinas.lt .

    6. Information about membership cancellation can only be found in the membership FAQ (Frequently Asked Questions) section, under questions 1 and 8.

    7. Visitors in the pool area are monitored by video cameras for their safety.

    8. Smoking (including electronic cigarettes and heated tobacco devices) is strictly prohibited in the Pool premises.

    9. The Manager is not responsible for the personal belongings of Visitors left in unlocked lockers or common areas. Found items are stored at the Pool reception for 7 (seven) calendar days.

    10. Each Visitor is entitled to use no more than one storage locker. When the locker is locked with a Smart Bracelet, a red indicator lights up, and when unlocked, the indicator becomes inactive. The Visitor must carefully check whether the locker is locked securely.

    11. Visitors must wear slippers suitable for use in wet, slippery environments, except in water baths and saunas.

    12. Swimming pool attire is required in the pool.

    13. Longer hair must be tied with a hair tie/braided.

    14. Visitors are required to shower before entering and exiting the Pool Area.

    15. The depth of the large pool (50 m) is 2.2 m, therefore only Visitors who can swim are allowed to use it. The depths of the other areas of the Pool are: 25 m pool – 0.8 m, entertainment pool – from 1.20 m to 1.40 m, and children's pool – 0.30 m.

    16. When sailing on the lanes, it is necessary to keep to the right.

    17. In the relaxation area, it is mandatory to place a towel under your entire body on the sun loungers.

    18. In certain areas requiring more attention, warning signs have been posted that must be followed.

    19. A visitor who notices any problems with the Pool equipment should immediately notify the Pool staff.

    20. The pool is periodically closed for maintenance: i) preventive maintenance works are carried out on the first Monday of each month (from 06:00 to 14:00), ii) in August the pool is closed for mandatory technical prevention and repair works. The manager reserves the right to change the time of performance of these works.

  7. POOL BAR RULES

    1. At the pool bar, alcoholic beverages are sold to visitors aged 20 and over, and energy drinks are sold to visitors aged 18 and over.

    2. Bar staff have the right to refuse to serve Visitors who are intoxicated with alcohol, narcotic/psychotropic substances, or persons behaving dangerously, without additional explanation.

    3. The visitor undertakes to consume alcoholic beverages responsibly and to assess their ability to remain alert and safe in the water.

    4. Alcoholic beverages are sold in the Pool area to legal entities for representational purposes only.

    5. Visitors undertake to consume drinks safely, not to pour into the pool and not to leave empty containers in places not designated for this purpose. It is forbidden to leave drinks unattended. The pool staff is not responsible for Visitors' drinks left unattended.

    6. Food and drinks are only allowed in designated areas – the bar area by the recreational pool. It is strictly forbidden to eat in the water, carry food or snacks to other areas of the Pool (except for food in special take-away containers), and take away the Bar's dishes and glasses.

    7. The Visitor or Responsible Person undertakes to pay in full for all goods and services purchased using the Smart Bracelets issued to him and/or to the persons under his supervision (Users). Before leaving the Pool, the Visitor or Responsible Person must pay for the incurred expenses and the used Credit at the exit or self-service checkout. Purchased goods and services can be paid for by bank card directly at the Pool Bar. If the goods or services are not paid for, the Manager will contact the Visitor or Responsible Person or contact the police.

  8. RULES OF THE BATH ZONE

    1. Visitors must keep quiet and not make noise in the sauna area.

    2. Visitors must have a towel in the sauna area.

    3. It is allowed to enter dry saunas only with a towel, which the Visitor must lay on the wooden loungers under his entire body in the sauna.

    4. It is necessary to shower before entering and using saunas, swimming pools, and whirlpools.

    5. Slippers must be left at the entrance to the sauna.

    6. The seating area in the steam room must be washed with a shower without disturbing the people nearby.

    7. It is recommended not to wear jewelry in the sauna area.

    8. Visitors who do not comply with the Bathhouse Zone Rules are warned. In case of repeated violation of the Bathhouse Zone Rules, the Visitor is obliged to leave the bathhouse zone, to which he may not be admitted in the future. For violations of the Bathhouse Zone Rules, the Visitor may also be subject to other sanctions provided for in these Rules.

    9. It is forbidden to pour your own perfumes or liquids onto the sauna stones.

    10. Minors under the age of 16 must be accompanied by an accompanying person in the sauna.

    11. All saunas are equipped with a "help button" to call rescuers in case of health risks.

  9. RULES FOR USING THE SLIDE/SKIDROW

    1. The slide can be used by Visitors from 3 (three) years of age. Children under 10 years of age can use the slide only under the supervision of an Accompanying Person. It is strictly forbidden to leave children under 10 years of age unattended.

    2. Skating is only allowed after making sure that the landing pool is filled with water.

    3. When using the slide, all specified safety requirements and instructions from the Pool staff must be followed.

    4. When using a slide (slide), it is prohibited to:

      1. run up the steps of the rink;

      2. to slide head down;

      3. to climb against the current;

      4. skating with clothing that contains sequins, zippers, snaps, buttons, etc. elements;

      5. skate with aids, i.e. life jackets, inflatable shoulder pads, and a lifebuoy.

  10. RULES FOR USING THE CHALLENGE TRAIL

    1. Only Visitors who are at least 120 cm tall, have a maximum weight of 120 kg, know how to swim and do not have any health conditions that could pose a danger to themselves or others may use the Challenge Trail. Visitors who are not confident in their swimming skills must wear life jackets, which are provided free of charge by the Lifeguards.

    2. Before climbing the Challenge Trail, it is mandatory to remove all jewelry (watches, chains, earrings, rings), glasses, and other sharp objects that could injure another Visitor or damage the Challenge Trail structure.

    3. A maximum of 20 people can be entertained on the Challenge Trail at a time, or as many as the Lifeguard directs.

    4. It is strictly forbidden:

      1. Children may use the Challenge Trail if they are not accompanied by an Accompanying Person;

      2. dive under the Challenge Trail or swim directly under it;

      3. to push other Visitors;

      4. perform dangerous acrobatic tricks ( e.g. somersaults, head-down jumps, etc.);

      5. climb the structures of the Challenge Trail with footwear (including pool slippers);

      6. It is strictly forbidden to use the Challenge Trail by persons under the influence of alcohol or any other psychotropic substances.

    5. If you fall into the water, you must immediately swim to the nearest edge of the pool without causing obstacles to other people using the pool.

    6. Visitors must unconditionally follow all instructions of the Lifeguard. The Lifeguard has the right to suspend use of the Challenge Trail at any time, and Visitors who ignore the Lifeguard's warnings or violate these Rules may be immediately removed from the Challenge Trail area without the right to return on the same day.

    7. The Manager is not liable for any injuries suffered due to the negligence of the Visitors themselves or failure to comply with these Rules.

  11. RULES FOR USING THE SHOWER SERVICE

    1. A visitor wishing to use the shower service must pay a fee of 3 EUR at the Pool Reception.

    2. The shower service can also be used by minors with the supervision of an accompanying person and minors over the age of 16 with the written consent of their parents/guardians.

    3. To use the shower service, the Visitor is issued a chip bracelet, the procedure for using which is specified in Chapter .

    4. The Visitor or Responsible Person confirms that the Visitor is physically healthy and has no health problems or complications that would prevent him/her from using this service and assumes full responsibility for his/her own and/or the User's health.

    5. After the shower service time (20 min.) has expired, the Visitor must leave the Pool, unless he has purchased another service that entitles him to use other Pool services (swimming lanes, SPA area, etc.). If the set time limit is exceeded , an additional fee is applied in accordance with clause .

  12. RULES FOR USING A HYDROMASSAGE BED

    1. A Visitor wishing to use the hydromassage bed must register at the Pool Reception. The registered Visitor is assigned a specific time.

    2. Upon arrival at the specified time, the Pool staff sets the selected duration of the hydromassage bed program (15, 20 or 30 minutes). If the Visitor does not show up at the appointed time and/or does not use the hydromassage bed through no fault of the Manager, the money paid is not refunded.

    3. The visitor confirms that he is physically healthy and has no complications that would prevent him from using the hydromassage bed and assumes full responsibility for his health.

    4. After the hydromassage service has ended, the Visitor must leave the Pool, unless he has purchased another service that entitles him to use other Pool services (swimming lanes, SPA area, etc.).

  13. RIGHTS AND OBLIGATIONS OF VISITORS

    1. The visitor has the right:

      1. use the services provided by the Pool;

      2. demand that the Manager compensate the Visitor for any damage incurred due to the fault of the Manager, in accordance with the procedure established in these Rules and legal acts.

    2. The Visitor has the right to perform diving exercises only after additionally informing the Lifeguard about it. When performing diving exercises, the Visitor assumes all responsibility and risks arising to his health and safety, including death or any other impairment of his health.

    3. The visitor undertakes:

      1. before starting to use the services provided by the Pool, make sure that his/her health condition and physical capabilities allow him/her to use them (negative consequences related to failure to comply with this requirement fall on the Visitor or the Responsible Person);

      2. while staying in the Pool and using the services provided therein, strictly comply with the requirements set out in these Rules;

      3. while in the Pool, use only the assigned Smart Bracelet;

      4. to follow the instructions of the Pool staff regarding safety requirements and compliance with these Rules;

      5. to listen to all instructions of the Lifeguards (the Pool staff has the right to ask a Visitor who does not follow the Lifeguard's instructions to leave);

      6. Only swimwear should be worn in the pool: women and girls - swimsuits, men and boys - swimming trunks;

      7. children under 3 years of age must wear specially designed waterproof diapers;

      8. minor children under the age of 16 must be accompanied by Accompanying Persons;

      9. Children under 6 years of age or under 130 cm tall in recreational pools with a depth of more than 80 cm must wear inflatable swimming sleeves, which can be obtained free of charge from the Lifeguards. Inflatable swimming sleeves are not mandatory if an Accompanying Person is in the water with the child and the child is no further than an outstretched arm's length away.

      10. leave the Pool and/or SPA area no later than 15 minutes before their closing time.

  14. DUTIES AND RESPONSIBILITIES OF ACCOMPANYING PERSONS

    1. Visitors under the age of 16 may visit the Pool only when accompanied by a Responsible Person (Accompanying Person), who must constantly supervise them (not leave them alone) and assumes full responsibility for the safety, health, behavior of the supervised children, compliance with these Rules, storage of children's belongings, secure locking of lockers, etc. One Accompanying Person may accompany no more than 4 (four) children, for whose health and safety he/she is fully responsible.

    2. Minors aged 16 to 18 who have read the Rules and have signed them may visit the Pool without an Accompanying Person, but they must have written consent from their parents/guardians in accordance with the Parental Consent Form approved by the Manager, which parents/guardians must sign at the Pool reception upon physical arrival with the minor child . The parental/guardian consent is valid for 90 calendar days.

    3. Disabled persons who, due to their health condition, require the care of another person may visit the Pool only when accompanied by a Personal Assistant or An accompanying person who assumes full responsibility for the safety of the disabled person, their health, compliance with these Rules, storage of belongings, secure locking of lockers, etc. The personal assistant has the right to enter the Pool free of charge.

  15. RIGHTS AND OBLIGATIONS OF THE MANAGER

    1. The manager has the right:

      1. not allow into the Pool persons whose behavior may disrupt public order, endanger the safety of other Visitors, the hygienic condition of the Pool and/or would contradict socially accepted norms of behavior;

      2. not allow persons into the Pool if they do not agree to comply with or do not understand these Rules;

      3. change the list of services provided by the Pool and (or) their fees at any time, without prior notice;

      4. to remove Visitors who violate the Rules, ignore warning signs, requirements specified on signs, or do not follow the instructions of the Pool staff. In such a case, the money paid to the Visitor shall not be refunded;

      5. unilaterally amend the Rules, redrafting them and publishing them on the Pool's website: https://www.zalgiriobaseinas.lt/lt/zalgirio-baseino-vidaus-tvarkos-taisykles ;

      6. not allow persons into the Pool without additional explanation;

      7. organize closed events (evenings) in the Pool, during which access to other persons may be restricted.

  16. RECOMMENDATIONS FOR VISITORS

    1. Visitors are recommended to responsibly assess their physical capabilities and health status (e.g. chronic illnesses, injuries, pregnancy, etc.).

    2. Visitors are not recommended to bring expensive and/or valuable items (jewelry, watches, mobile phones, etc.) to the Pool, which may be damaged due to moisture or be lost. Use the services provided by the Pool while wearing any type of jewelry or other jewellery that may cause damage to Visitors and/or the Pool's inventory.

    3. It is strictly not recommended to jump, dive, do tricks, hold your breath underwater, attempt to cross a pool, or perform other difficult or risky actions.

  17. PROHIBITIONS FOR VISITORS

    1. In the pool, visitors are prohibited from:

      1. shout loudly, whistle, falsely call for help, run (the Visitor may slip and get injured), push, act rudely or otherwise interfere with other Visitors from using the Pool services;

      2. bring glass, breakable, sharp objects;

      3. bring food and drinks (except drinking water in unbreakable containers);

      4. visit with animals;

      5. skating on the stair railings, climbing steel structures or otherwise damaging the inventory in the Pool;

      6. spitting on the floor and in the water, performing natural needs outside the toilets;

      7. leave minor children under the age of 16 without constant supervision of Accompanying Persons;

      8. wear outdoor footwear, except in the area leading to the changing room;

      9. use a smart bracelet not assigned to the Visitor;

      10. jumping into the water from the edges of swimming pools, hot tubs, diving in hot tubs;

      11. children under 3 years of age cannot swim in pools without specially designed diapers;

      12. to film and take photographs in all areas of the Pool without the permission of the Manager;

      13. pouring drinks into swimming pools or hot tubs;

      14. shave and/or perform hair removal procedures in the Swimming Pool premises;

      15. wringing out wet clothes (swimsuits, shorts, towels, etc.) on the floor in changing rooms;

      16. Visiting the pool/being intoxicated by alcohol, narcotics and psychotropic substances;

      17. use the Pool services if you have health problems or are feeling unwell;

      18. Provide commercial services to visitors without the Manager's written consent (the Manager reserves the right to prohibit the performance of activities without any explanation);

      19. to swim naked in swimming pools and saunas;

      20. arbitrarily set, change and/or stop the set function of the hydromassage bath;

      21. use the hot tub or otherwise change or control the settings of the hot tub without the consent of the Pool staff;

      22. remove any Pool inventory;

      23. wear shoes, slippers or any other type of footwear in water baths;

      24. perform any other actions prohibited by these Rules.

    2. The following is prohibited in the sauna area:

      1. bring your own infusions, extracts and wraps to the saunas and use them there;

      2. in saunas, pour water yourself onto stones or temperature sensors;

      3. to regulate devices in sauna rooms;

      4. be intoxicated by alcohol, narcotics and psychotropic substances in saunas;

      5. leave minor children under the age of 16 without the constant supervision of an Accompanying Person;

      6. wear shoes, slippers or any other type of footwear in saunas;

      7. use the "help button" for purposes other than those specified;

      8. perform any other actions prohibited by these Rules.

  18. RESPONSIBILITY

    1. A Visitor who causes damage to the Pool's infrastructure, equipment, environment, Visitors' property in the Pool, health, etc. is liable in accordance with the procedure established by the laws of the Republic of Lithuania. Responsible Persons are liable for damage caused by the actions (inaction) of Users (including minors or disabled persons).

    2. The amount of damage for damaged infrastructure of the Pool, environment, lost or damaged inventory is determined according to the rates approved at that time. If a specific rate is not established, the damage is assessed according to the cost of restoration or acquisition of the property.

    3. If the Visitor or the Responsible Person is unable to pay for the additional time spent or services provided, the losses incurred by the Manager shall be recovered from the Visitor or the Responsible Person in accordance with the procedure established by the laws of the Republic of Lithuania.

    4. The Pool Administration has the right to oblige Visitors who violate the Rules or do not follow the instructions of the Pool staff to leave the Pool premises. In such a case, the money paid for Pool services is not refunded. For failure to comply with the Rules, a Visitor or Responsible Person may also be subject to a 1-month ban from visiting the Pool. For a second violation, a 3-month ban is applied, for a third time - 6 months, for a fourth time - a 1-year ban from visiting the Pool. For a serious violation, a Visitor or Responsible Person is subject to a 3-month ban from visiting the Pool. For a second violation, a 6-month ban is applied, for a third time - a 1-year ban from visiting the Pool.

    5. If the pool staff suspects that a Visitor has committed a criminal act, the police are immediately notified.

    6. The Manager is not responsible for the personal belongings of Visitors or their loss and/or partial damage, including Visitors' swimsuits damaged by slides or chlorinated water, as well as when using clothes (swimsuit) dryers.

    7. The Manager is not liable for damage to the health or property of Visitors and damage to third parties if it occurred due to the negligence of Visitors, violation of these Rules, ignoring warning signs or failure to comply with lawful instructions of the Pool staff. A Visitor or Responsible Person who has suffered damage or noticed it must immediately (before leaving the Pool) notify the Pool staff of the incident, indicating the place, time and circumstances. If the damage is not reported immediately, subsequent claims or complaints regarding health and (or) property damage will not be accepted and considered. The Manager also does not accept any claims for damage if the Visitor or Responsible Person has failed to comply with the requirements and recommendations established in these Rules.



  1. FINAL PROVISIONS

    1. Disputes regarding improper implementation or non-implementation of the Rules shall be considered in accordance with the procedure established by the Law on Consumer Rights Protection of the Republic of Lithuania at the State Consumer Rights Protection Service, address Vilniaus g. 25, 01402 Vilnius, e-mail: tarnyba@vvtat.lt, tel. (8 5) 262 67 51, website www.vvtat.lt . Visitors may submit an application electronically via the platform http://ec.europa.eu/odr/ .

    2. These Rules shall enter into force from the date of their approval and shall remain in force until the approval of a new version of the Rules or their recognition as invalid. These Rules may be revised, amended or supplemented. Amendments or supplements to the Rules shall enter into force from the date specified therein and shall be considered an integral part of these Rules.

    3. Visitors (or Responsible Persons in the cases provided for in these Rules) are acquainted with the Rules and all their amendments or additions upon signature.
